Divorce in Australia if living overseas

We’ve received an inquiry from Sam asking whether they can get a divorce in Australia if they live overseas.

In short, “yes, you can” provided there is a geographical link between Australia and either you or your partner so whether that be an Australian citizen or you’ve ordinarily resided here for 12 months prior to filing for divorce and provided you meet the substantive requirement of there being an irretrievable breakdown of the relationship, then, yes you can get a divorce.
